Welcome to Scarlett Avenue. This website is operated by Scarlett Avenue. Throughout the site, the terms “we”, “us”, and “our” refer to Scarlett Avenue. Scarlett Avenue offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions, and policies referenced herein and/or available via hyperlink (including our Shipping and Return Policies).

Section 1 – On-Demand Manufacturing & Print Fulfillment

  • Print-on-Demand Model: Scarlett Avenue operates as a bespoke, print-on-demand brand. All items available in our store are made to order individually following purchase confirmation.

  • Third-Party Production: We partner with Gelato, a decentralized third-party global print-on-demand production and logistics network. When you complete an order, your order specifications and shipping details are routed to Gelato’s production partner facilities located globally.

  • Manufacturing Variations: Because each piece is manufactured individually, slight variations in garment placement, color saturation, and physical dimensions (typically within industry standard tolerances of ±2–3%) may occur between digital mockups and the physical end product.

Section 2 – Order Acceptance, Modifications & Cancellations

  • Immediate Processing: Due to our automated integration with Gelato, order details are often routed directly into production shortly after checkout to ensure fast turnaround times.

  • Cancellations & Edits: Requests to change a size, update a delivery address, or cancel an order must be submitted immediately. Once an order enters production or fulfillment within the Gelato network, it cannot be canceled, redirected, or altered. We do not guarantee that modification requests submitted post-checkout can be honored.

Section 3 – Pricing, Product Accuracy & Colors

  • Price Changes: Prices for our items are subject to change without notice. We reserve the right at any time to modify or discontinue any product without liability to you or any third party.

  • Color Display: We make every effort to display the colors and images of our products as accurately as possible. However, monitor displays, screen resolutions, and print substrate textures vary; we cannot guarantee that your device’s display of any color will accurately reflect the final printed item.

Section 4 – Shipping, Delivery & Customs

  • Fulfillment Timeframes: Production times and shipping transit times are separate. Production turnaround typically ranges between 1–4 business days, followed by carrier transit. Estimated delivery windows provided at checkout or in our Shipping Policy are non-binding estimates.

  • Failed Delivery / Incorrect Address: You are solely responsible for providing complete and accurate shipping information. If a delivery fails due to an incorrect or incomplete address provided at checkout, or failure to collect the package from a local carrier pickup point, reshipment fees will be charged to the customer.

  • Customs, Duties & Import Taxes: Orders crossing international borders may be subject to customs duties, tariffs, and taxes imposed by the destination country. Scarlett Avenue is not responsible for these fees; they are the sole responsibility of the customer.

Section 5 – Returns, Refunds & Quality Guarantee

  • Made-to-Order Limitations: Because each item is produced on demand specifically for you, we do not accept returns or exchanges for buyer’s remorse, incorrect size selection, or customer preference. Please refer closely to our posted size charts prior to ordering.

  • Defective, Damaged, or Incorrect Items: If an item arrives damaged, flawed, or materially misprinted due to an error in production or transit:

    • You must contact us within 14 days of delivery at support@scarlettavenue.com.

    • You must provide your order number alongside clear photographic evidence showing the defect, tag, and full product view.

    • Confirmed manufacturing defects will be replaced free of charge or refunded at our discretion.

Section 6 – Intellectual Property & Artwork

All designs, text, brand assets, product graphics, signature line concepts, and logos on this website are the proprietary intellectual property of Scarlett Avenue or our respective licensors. Unauthorized copying, reproduction, redistribution, or resale of any artwork or branded elements is strictly prohibited.

Section 7 – Third-Party Services & Links

Our store is hosted on Shopify Inc., which provides the online e-commerce platform allowing us to sell our products. Production, fulfillment, and drop-shipping logistics are handled via Gelato and their associated carrier partners. We are not liable for any harm, damages, or delays resulting from third-party software outages, carrier transit strikes, or postal disruptions outside of our reasonable control.

Section 8 – Disclaimer of Warranties & Limitation of Liability

We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.

To the maximum extent permitted by law, Scarlett Avenue, its directors, officers, employees, affiliates, and suppliers (including Gelato) shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind—including lost profits, lost revenue, lost savings, or replacement costs—arising from your use of the service or any product procured using the service.

Section 9 – Governing Law & Severability

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the jurisdiction where Scarlett Avenue is established (e.g., England and Wales / United Kingdom). If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall remain enforceable to the fullest extent permitted by law, and the remainder of these Terms shall remain valid and binding.
